1. Acceptance of Terms

By downloading, installing, accessing, or using the Fixchy mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Fixchy ("we", "our", or "us") operates a marketplace that connects drivers with auto parts dealers and service businesses across Iraq. These Terms apply to all users, including drivers, business sellers, and visitors.

2. Use of the App

Fixchy provides a platform for discovering auto parts and services, messaging sellers, and accessing an AI-powered assistant. We do not sell parts or perform services ourselves — transactions and agreements are between users and listed businesses.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to:

• Provide accurate information when creating an account or listing items
• Use the Service in compliance with applicable laws in Iraq
• Respect other users and communicate in good faith
• Keep your login credentials secure and notify us of unauthorized access

3. User Accounts

To access certain features, you must create an account. You may register as a driver (buyer) or a business (seller). You are responsible for all activity that occurs under your account.

• You must be at least 13 years old to create an account
• One person or entity may not maintain more than one account without our approval
• We may suspend or terminate accounts that violate these Terms
• You may delete your account at any time through the app settings or by contacting us

4. Business Accounts

Business accounts may list parts, services, and business profile information on the marketplace. By registering as a business, you represent that:

• You are authorized to operate the business you represent
• Your listings accurately describe the parts or services offered
• You will respond to customer inquiries in a timely and professional manner
• You comply with all applicable commercial and tax regulations

Business accounts are subject to approval. We reserve the right to reject, suspend, or remove business listings that do not meet our quality or compliance standards.

5. Marketplace Rules

When using the Fixchy marketplace, all users agree to:

• List only genuine auto parts and legitimate automotive services
• Display accurate prices, descriptions, and availability
• Not misrepresent vehicle compatibility, condition, or service scope
• Honor agreements made through in-app messaging when feasible
• Report suspicious or fraudulent listings to Fixchy support

Fixchy is not a party to transactions between drivers and businesses. We do not guarantee the quality, safety, or legality of listed items or services, nor the accuracy of business profiles.

6. Prohibited Activities

You may not use the Service to:

• Post false, misleading, or fraudulent listings
• Sell stolen, counterfeit, or illegal goods
• Harass, threaten, or abuse other users
• Spam, scrape, or automate access without permission
• Attempt to bypass security, access controls, or rate limits
• Upload malware, viruses, or harmful code
• Impersonate another person, business, or Fixchy staff
• Use the Service for any unlawful purpose

Violation of these rules may result in immediate account suspension or permanent removal from the platform.

7. Intellectual Property

The Fixchy name, logo, app design, and original content are owned by Fixchy and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our branding or software without written permission.

You retain ownership of content you submit (listings, messages, photos). By posting content on Fixchy, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and distribute that content solely to operate and promote the Service.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Fixchy disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

Fixchy is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

9. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app, by email, or by posting a notice on our website. The "Last updated" date at the top of this page reflects the most recent revision.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
